Terms of Service

These Terms of Service ("Terms") govern your access to and use of FieldSync Pro ("the Service"), a HubSpot integration application provided by FieldSync Pro ("we," "us," or "our"). By installing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing FieldSync Pro from the HubSpot Marketplace, creating an account, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not install or use the Service.

2. Description of Service

FieldSync Pro is a HubSpot integration that provides property synchronization, rollup calculations, calculated fields, and conditional data rules between HubSpot CRM objects. The Service operates by connecting to your HubSpot portal via OAuth 2.0 and the HubSpot API.

The Service is provided "as is" and "as available." We continuously improve the Service and may add, modify, or remove features with reasonable notice.

3. Account Terms

  • You must have a valid HubSpot account to use FieldSync Pro
  • You are responsible for maintaining the security of your HubSpot account and OAuth authorization
  • You must provide accurate account information
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • One HubSpot portal per FieldSync Pro account (multi-portal support requires separate subscriptions)

4. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or regulation
  • Attempt to circumvent plan limits, rate limits, or other technical restrictions
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit malicious code or interfere with other users
  • Resell or redistribute the Service without our written consent
  • Use the Service in a manner that could damage, disable, or impair our infrastructure

5. Payment and Billing

5.1 Pricing

FieldSync Pro offers Free, Starter, Professional, and Enterprise plans as described on our Pricing page. Prices are in US Dollars and do not include applicable taxes.

5.2 Payment Processing

All payments are processed by Polar ("Payment Processor"). By subscribing to a paid plan, you agree to Polar's terms of service. We do not store credit card information directly.

5.3 Billing Cycle

Paid plans are billed monthly or annually, depending on your selection. Billing begins on the date you upgrade from the Free plan. Annual plans are billed upfront for the full year.

5.4 Upgrades and Downgrades

You may upgrade your plan at any time. Upgrades take effect immediately and are prorated for the remainder of your billing cycle. Downgrades take effect at the end of your current billing period. When downgrading, features beyond your new plan's limits will be deactivated but not deleted — they will reactivate if you upgrade again.

5.5 Refunds

We offer a 14-day money-back guarantee on all paid plans. If you are unsatisfied within 14 days of your initial purchase or upgrade, contact us for a full refund. After the 14-day period, refunds are issued at our discretion.

6. Plan Limits

Each plan has limits on the number of sync rules and records processed per month. When you reach your limit:

  • You will receive email notifications at 80% and 100% of your limit
  • Sync operations will pause until the next billing cycle or until you upgrade
  • No data will be lost — pending syncs will queue and execute when capacity is available
  • Existing sync rules will not be deleted

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. You retain all rights to your HubSpot CRM data. We do not claim ownership of any data processed through the Service.

8. Intellectual Property

The Service, including all software, design, text, and graphics, is owned by FieldSync Pro and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. The Service depends on third-party infrastructure including HubSpot's API and Cloudflare's network. Scheduled maintenance will be communicated in advance when possible.

10. Limitation of Liability

To the maximum extent permitted by law, FieldSync Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total cumulative liability to you for all claims related to the Service shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FieldSync Pro from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may stop using the Service at any time by uninstalling FieldSync Pro from your HubSpot portal. We may suspend or terminate your access if you violate these Terms or if required by law.

Upon termination:

  • Your sync rules will stop executing immediately
  • Your data will be deleted in accordance with our Privacy Policy
  • No refund will be issued for the unused portion of your billing period (except during the 14-day guarantee period)

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.
